Former President Donald Trump’s lawyers on Wednesday filed a motion for a mistrial in a $250 million New York civil fraud case, claiming that Judge Arthur Engoron and his principal law clerk demonstrated bias. The motion was filed after Engoron issued a partial gag order prohibiting Trump from making disparaging remarks about his law clerk during the trial.

Ty Cobb, a former Trump White House attorney, explained on Tuesday why Donald Trump’s “off the rails” rhetoric and attacks on those overseeing or involved in his myriad legal cases will first see the former president being sanctioned and then at some point will “result in him being put his jail pending some of these trials.”

Trump’s legal team argued that Engoron is too “intertwined” with his clerk, who has passed him notes and sometimes whispered to him during testimony. The defendant’s filing largely focuses on their observations of interactions between the judge and his law clerk in the case.

Trump earlier Tuesday shared another user’s post on his Truth Social platform which said they would like to see New York State Attorney Letitia James and Judge Arthur Engoron placed under citizens’ arrest. This post was seen as a further attack on those overseeing his legal cases.

The motion for a mistrial is currently being considered by Judge Engoron, who is overseeing the case. It is unclear at this time what the outcome of the motion will be.
