A federal court filing on Sunday pushed back against claims that a video of so-called “QAnon Shaman” Jacob Chansley exonerated anyone in the mob at the US Capitol on January 6, 2021. The video, which was aired on Fox News host Tucker Carlson’s show last week, was used by defense attorney Roger Roots to request the dismissal of the case against Proud Boy Dominic Pezzola, who allegedly used a riot shield to initiate the breach of the Capitol.

In the court filing, prosecutors argued that the video lacked the context of what occurred before and after the footage. They said that the video did not show Chansley facing off with officers for half an hour outside the Senate chamber or when Chansley refused to be escorted out of the Capitol by an officer and only left after being forcibly removed.

The Justice Department attorneys also argued that Carlson’s portrayal of the rioter’s activities was misleading. They said that the video did not exonerate anyone in the mob and that the seditious conspiracy trial against the five Proud Boys leaders should not be dismissed based on the footage.

Chansley was sentenced to 41 months in prison for his actions on January 6. The court filing on Sunday is the latest development in the ongoing legal proceedings against those involved in the Capitol breach. It remains to be seen whether the defense’s request to dismiss the case against Pezzola will be granted.
