Appeals Court Partially Grants Request to Freeze Texas Judge’s Order Limiting Access to Mifepristone Abortion Drug

A federal appeals court has partially granted a request to freeze parts of a Texas judge’s order that would have suspended the US Food and Drug Administration’s approval of a medication abortion drug, mifepristone. The court’s order will keep the approval in effect and the drug on the market while an expedited appeal plays out, but under tighter rules that would allow the drug only to be dispensed up to seven weeks, not 10, and not by mail. The decision is expected to be appealed to the Supreme Court.

Biden Administration Appeals Ruling That Would Have Endangered Access to Abortion Pill Mifepristone

The Department of Justice has filed a request in a federal appeals court to block a ruling from a Trump-appointed judge that would have endangered access to the abortion pill mifepristone. The Biden administration is arguing that the ruling is "extraordinary and unprecedented" and should be stayed pending appeal. The FDA approved mifepristone in 2000 and it has since become one of the most commonly used abortion pills, used in combination with another drug to terminate a pregnancy.

Twelve Democratic-led States File Lawsuit to Expand Access to Abortion Pill Mifepristone in Face of Potential Restrictions

Twelve Democratic-led states have filed a lawsuit in federal court to challenge restrictions on the abortion pill mifepristone, which is used in over half of U.S. abortions. An anti-abortion group in Texas has also filed a lawsuit seeking to restrict access to the drug, leading the Biden administration to prepare for a worst-case scenario. The lawsuit filed by the twelve Democratic-led states aims to ensure that mifepristone and misoprostol remain available to women who need them.
