Former President Donald Trump’s lawyers have filed a motion in federal court in Manhattan, asking for a new trial or a reduction in damages in a case brought against him by writer E. Jean Carroll. The jury in the case found Trump liable for sexual abuse and defamation and awarded Carroll $5 million in damages.

Trump’s attorneys argued that the $2 million portion of the award for battery was excessive because the jury did not find that Trump had raped Carroll. They argued that the jury only found that Trump had sexually abused her. The lawyers contended that the verdict was “grossly excessive” and that Trump should either get a new trial or have to pay less in damages.

Carroll had testified that she and Trump had been amiably chatting in a New York City department store in the 1990s when he suddenly attacked her. She said that Trump had pushed her against a wall, pulled down her tights, and penetrated her with his fingers.

Trump has denied the allegations and his lawyers argued that the jury’s verdict was not supported by the evidence. They argued that the jury had been swayed by “inflammatory and prejudicial evidence” and that the award was “grossly excessive.”

The court has yet to rule on the motion.
